Consultation on Proposed Education (Wales) Measure

The NAW Legislation Committee has launched a public consultation and call for evidence on the general principles of the proposed new Education (
The Measure, which if passed, will have a similar effect to an Act of Parliament, aims to extend the rights of children by enabling them to make appeals to the Special Educational Needs Tribunal for Wales, a right which corresponds with the existing rights of parents. The Measure is also intended to amend the Disability Discrimination Act 1995 so that children will have the right to make claims of disability discrimination to the Tribunal.
The proposed Measure will amend the current law which provides parents with the right to make appeals and claims to the Tribunal.
Following consultation, the Committee will report on the Measure’s general principles. The report will consider the need for the Measure, whether the Measure will achieve its stated objectives, whether key provisions are appropriate to deliver the Measure’s objectives, possible barriers to implementing the key provisions and the views of the stakeholders.
The Measure will contain powers for the Welsh Ministers to make subordinate legislation deriving from the Measure.
The powers to make subordinate legislation under the Measure will be extensive and the Committee has invited the Minister for Children, Education, Lifelong Learning and Skills to attend the Committee meeting on Monday 1st June to answer questions about the Measure’s delegated powers provisions.
Whilst the Legislation Committee is inviting the public’s views on the principles contained in the Measure, the Assembly’s Committee on Subordinate Legislation is writing to selected specialist bodies and organisations, to seek their views on the Measure’s delegated powers.
