The NHS Redress (Wales) Measure 2008

An Assembly Measure can repeal, amend or extend existing law for Wales. This means that gradually the law of England and Wales will diverge in areas covered by the devolved Fields and where the Assembly has legislative competence. Morgan Cole can update you on areas which are under consideration for legislative change, the progress of a proposed draft Assembly Measure and its effect on Welsh law.
Once the Assembly has been given the legislative competence to make Measures in relation to a specific Matter, the competence continues into the future. Over time the Assembly’s competence to make Measures in the devolved field of government will therefore increase.
The Welsh Assembly Government will propose draft Measures in an area where the Assembly enjoys legislative competence and bring then before the Assembly for scrutiny and consideration. It is assumed that before so doing the Assembly will carry out appropriate consultation. This is an opportunity for groups with an interest to lobby their views. The Assembly itself or an Assembly Committee or an AM may also propose a draft Assembly Measure
The Assembly Standing Orders set out a procedure for the scrutiny of a Measure by the Assembly which is similar to the Bill process through parliament. There are four stages for consideration:
- First Stage: Consideration of General Principles
- Second Stage: Detailed Consideration by Committee
- Third Stage: Detailed Consideration by Assembly
- Fourth Stage: Final approval
Once it has been through the requisite stages of scrutiny and is passed by the Assembly then it will take effect after being approved by the Queen in Council.
